Austria Legalizes Gay and Lesbian Marriage at the Beginning of 2019

Austria’s Constitutional Court will allow same-sex couples to marry at the beginning of 2019 after it ruled that the current laws are discriminatory. Austria’s gay and lesbian community has been able to enter in to legal partnerships since 2010, but will soon be able to enter full equal marriage.

The Court looked at the country’s 2009 marriage law after two women were refused to enter a formal marriage.

Civil partnerships will still be available at the beginning of 2019, and opposite-sex couples may also enter into one.

Austria’s Constitutional Court said: “the distinction between marriage and civil partnership can no longer be maintained today without discriminating against same-sex couples,” adding that keeping the two institutions separate suggests that “people with same-sex sexual orientation are not equal to people with heterosexual orientation”.
